Gillmans Commercial Appliances Terms & Conditions
In these terms and conditions of sales terms means `Terms and Conditions of Sale` and `goods` means goods and/or services.
Payment and Price
All prices are in £ sterling and are exclusive of VAT at the current rate unless otherwise stated. We reserve the right to change any advertised price before you place an order.
In the event that an error is discovered with the price of any goods you may have ordered we will inform you as soon as we can possibly contact you whereupon we will give you the option of amending and processing your order at the correct price or cancelling it. In the possible event that we cannot contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods we will give you a full refund.
Prices are subject to change without notice.
Availability of Goods
All products and services are subject to availability and may be withdrawn at any time. If owing to non-availability of the goods, you will be offered an alternative or given a full refund at your request.
We at Gillman`s Commercial Appliance undertake that within 12 months of the date of purchase if your new appliance or any part thereof is proven to be defective by reason only of faulty workmanship or materials we will at our option repair or replace the same free of charge for labour, materials or carriage on condition that:
- The appliance has been correctly installed and used on the electricity supply stated on the rating plate.
- The appliance has been used for normal commercial purposes only in accordance with the manufacturer`s instructions.
- The appliance has not been serviced, maintained, repaired, taken apart or tampered with by persons not authorised by Gillman`s Appliance Specialists or the manufacturer.
- All service work under this guarantee must be undertaken by the manufacturer`s service representative or our authorised agent.
- The guarantee is in addition to your statutory and other legal rights.
- Manufacturer`s home visits, under guarantee, are made between 8.30 a.m. and 5.30 p.m. Monday to Friday. Visits may be available outside these hours in which case a small charge will be made.
Online and Phone Ordering Returns Policy
Gillman’s will exchange or refund your purchase up to 28 days following the day of delivery, the item must be returned unopened and in its original packaging, complete with any free gifts or accessories provided
Distance Selling Regulations
If you open the goods to inspect them, you can cancel your purchase up to 7 working days following the day of delivery ("Working days" means all days other than Saturday, Sunday and Public Holidays).
If cancelling your purchase under the Distance Selling Regulations, your product must be complete and in `as new` condition. If you have opened the box to examine the product you must have done so without damaging or marking the product. The product must not have been used or installed or run through any set up mode. It should be returned where possible in the original box and packaging, along with any accessories you received with it. Any free gifts received with the product must also be returned.
To cancel your purchase
You must notify Gillman’s either in writing or by email of your intent to cancel. We must receive at least 24 hours’ notice prior to the delivery day of your wish to cancel. Your item must be returned to the Gillman’s showroom along with your receipt and bringing the card you paid with then we can credit it (Gillman’s are unable to credit any card other than the one the original order was placed on)
If you follow the above, Gillman’s will issue you with a full refund for the cost of the product and any delivery charge paid. However we reserve the right to retain any charge paid for services which have already begun or been completed e.g. installation or uplift of an old unit. We may make a charge for items that have been dispatched and you refuse to accept delivery, or are not available to accept the delivery on the agreed day. Refunds take 3-5 workings days to be credited to your card.
Whilst you are in possession of the goods you must take reasonable care of them and not use them.
Should you wish for Gillman’s to collect your item you may incur a collection charge.
Whilst we make every effort to ensure we deliver your items on time, we cannot be held responsible for deliveries that are late due to situations outside of our control, for example road closures, diversions or weather conditions. We will make every effort to keep you updated if your delivery is likely to be delayed as soon as we are aware of any situation.
Our installation service should be ordered at the time of making your purchase.
Installation is only to current, available suitable services currently in place, we do not accept any liability for failure to complete an appliance installation due to:
- The current services not meeting the correct standards for the new appliance.
- Extra installation works being delayed or unforeseen additional work that is found to be required.
We may need to carry out a site survey prior to a delivery date being agreed, we will contact you to arrange this.
Commercial appliances/special orders
We reserve the right to levy a handling / restocking charge on stock items of 20% and special order items of 30%.
No liability for any claim for:
(a) Damage in transit will be accepted unless we are notified within 48 hours from delivery.
(b) Non-delivery will be accepted unless we are notified within 10 working days from the expected delivery date.
(c) Shortages and incorrect goods supplied will be accepted unless we are notified within 48 hours from delivery.
We are committed to protecting your privacy.
We will only use the information that we collect about you lawfully
(in accordance with the Data Protection Act 1998).
If we collect information about you via online forms, it is for 2 reasons:
firstly, to process your order and
secondly, to provide you with the best possible service.
We will give you the chance to refuse any marketing email from us in the future.
The type of information we might collect about you includes:
your name, email address, address (online orders only), phone number (online orders only), credit/debit card details (in secure pages for online orders only).
We will never collect sensitive information about you without your explicit consent.
The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly.
The personal information which we hold will be held securely in accordance with our internal security policy and the law.
If we intend to transfer your information outside the EEA (European Economic Area) we will always obtain your consent first.
We use a session cookie (which has already been set) to track the goods that are added to your shopping basket, this cookie is essential so that the website can "remember" what products are in your shopping cart as you move from page to page. Session cookies expire once you have left this website, parts of the site will not work if this cookie is not permitted. If you do not wish to allow the use of this cookie you may leave this website and the cookie will expire / be removed.
Gillmans Commercial Appliances accepts no responsibility for any losses, claims, damages, costs, charges, expenses, liabilities, demands, proceedings and actions which persons using this website may sustain or incur or which may be brought or established against it by any person and any case which arises out or in relation to or by reason of their use of this website.
